Intellectual Property Rights

Intellectual property is a holistic concept that includes copyrights, trademark rights, patent rights, design rights, utility model rights, etc. on intangible products. Copyright covers all kinds of intellectual and artistic works, such as science and literature, music, fine arts or cinema, including computer programs and software.

Intellectual property law aims to protect these rights, which have both financial and moral dimensions, regarding intangible works and assets. In Turkish law, this area is generally covered under the Intellectual and Artistic Works Law No. 5846 and the Industrial Property Law No. 6769.

In case of any infringement of IP rights, action against the unauthorised use, conducting criminal proceedings on the infringers, compensating the material and moral damages of the rights holders, and taking legal action in case of unfair registration are effective mechanisms for the protection of IP rights.

Right holders may monetize their intellectual property in various forms. In this context, licensing agreements is a common way of exercising financial rights over intellectual goods. License agreements may cover trademarks, patents, designs, or intellectual and artistic works. Transfer of financial rights over intellectual and artistic works can also be viewed as a way to exploit intellectual property rights.
